Saskatchewan Credit Unions Torpedo Bank Act Security
Against initial odds placed by many commentators, Layh & Associates emerged victoriously in two cases before the Supreme Court of Canada. In tandem decisions, released November 5, 2010, the Court held that two Saskatchewan Credit Unions, each with unregistered personal property security interests, defeated later taken Bank Act security interests in the same collateral. These decisions have garnered national attention and will provide strong incentive for chartered banks to abandon Bank Act security interests and register provincially recognized security interests in the Personal Property Registries where determining priority is precise and consistent among all secured creditors.
